Terms and Conditions of OZTranslation Services

The Company offers a platform for clients to arrange and purchase translation and interpretation services. These services are provided online or per the Company’s instructions. The Company does not guarantee availability and will not be held accountable for data loss or service interruption.

These terms and conditions constitute a complete understanding between the parties and supersede all prior versions, agreements, and negotiations related to the Company’s subject matter. It is imperative to note that the Company provides these services on an “AS IS, AS Accessible” basis.

Translation Rights And Copyright In Source Material

The Company acknowledges an agreement from the Client, subject to the condition that execution of the translation assignment will not infringe upon any third-party rights. The Client agrees to reimburse and hold the Company and the Translator harmless from any claim arising from the infringement of any copyright or other intellectual property rights in all cases. 

Furthermore, the Client agrees to reimburse and does not hold the Company and the Translator liable for any legal action, including but not limited to defamation, that may arise from the content of the source material or its translation. The Company and the Translator must not be held accountable for any damages or losses resulting from such legal action.

Cancellation Policy

1. In the event that the Client desires to cancel an Order, they must provide written notice to the Company. The Company has the right to impose an administration fee not exceeding 50% of the total fee payable if the cancellation occurs before the Services have commenced. If the cancellation occurs after the Services have started, the total fee is payable, and no refund will be issued.

2.It should be noted that all payments are final and non-refundable. Once the translation assignment has been commissioned and commenced by a translator, cancellation requests, reductions in scope, or frustration due to an act or omission of the Client or any third party cannot be accepted. In such cases, the Client is required to pay the full sum unless otherwise agreed upon in advance.

3. A discount may be given if the Client cancels an arrangement before the Translator begins the translation/interpretation. However, the Company reserves the right to determine whether a request for a refund merits a full or partial refund.
4.It is imperative that the Client receives the completed work on the due date and in the manner specified within the order. The Client or their authorised representative must promptly acknowledge receipt of the performed work. This acknowledgement implies that the job was completed within the agreed-upon due date and delivered in the agreed-upon manner.

5. With the proviso that the Client fails to fulfil the responsibilities outlined in this Article and does not raise any questions about the work within 24 hours after the delivery due date, it will be assumed that the Client received the work on the specified due date and accepted it.

6.The delivery date may be extended in cases where additional information is required from the Client, such as queries about spelling or illegible text. The Client must provide the requested information promptly to avoid any delays.

Delivery

Payment And Charges

All clients must make full payment before their orders. In case of credit approval, the payment schedule will be established seven days after the invoice date. We request all clients to comply with this policy to ensure the smooth and timely processing of their orders.

Change Requests

The translators will do their best to provide high-quality, translated documents. Should the Client not be satisfied with the translation, at that point, the Client must request changes. Please note that NAATI-certified translators will only accept requests that are in line with NAATI guidelines. They will not be able to add or remove information from the documents as per the Client’s requests if it does not abide by the NAATI guidelines. Such alter requests and quality concerns don’t entitle the Client to cancel or rebate.

Other Terms

Any additional work outside our proposed project scope will incur extra charges. If extra components or items have been requested for this project, the ultimate instalment amount may vary.

If a claim is made due to a mistake, it may not be considered valid after the time limit for complaints has passed. The Client must inform the contractor of any errors in the work performed as soon as possible but within 30 days of receiving the work.

If an unexpected delay occurs, we will notify the Client immediately. However, late delivery does not allow the Client to cancel. We will discount 10% of the order value for any late delivery.
